Legal Eagle Q & A: Is there such a thing of right's of a Common Law Wife?

July 7, 2019 by Melinda @ Giles Wilson Solicitors

Question:  How long do I have to have lived with my partner for her to get the rights of a common law wife?

Answer: Actually, the term “common law wife” has no basis in law. That is not to say that living together does not give rise to claims on inheritance or even a break up- it will all depend upon your circumstances. It is usually wise to have a co-habitation agreement and a will in place at least.
