Legal Eagle: No Show Workers & Refunds

October 22, 2017 by Melinda @ Giles Wilson Solicitors

Question: I employed a landscape gardener to do some work for me. He quoted £3,000 for the job and asked for £750 up front for materials and has not now returned to the job and is ignoring all contact. What can I do?

Answer: You can take action in the small claims court for breach of contract and the return of your money. Unfortunately the small claims court rarely orders a claim for costs even in a successful case (and it sounds as though you may have a good chance of success). Therefore you can try to deal with this yourself, or employ a solicitor. By employing a solicitor dare I say that you may have more of a chance of success but you will have to pay the costs yourself but you would at least get back your £750 all being well.
