Legal Eagle Q & A: How do Wills apply when extended family are involved?

April 22, 2018 by Joanna

Question
:  My mum and dad divorced years ago and my dad re-married.  He has died suddenly and my step-mum tells me that as he did not have a will and that my brother and I are not entitled to anything. Is this right? I am also so sure that he did make a will as he told me that I would get something.

Answer:  It is worth exploring whether your father did make a will – ask around with local solicitors or will makers.  However, if he did not then whether you inherit anything will depend upon the value of your father’s estate.  If his assets are worth over £250,000 then possibly you are entitled to a part of the estate or if your father was financially supporting you then you may be entitled to a claim for dependancy.
